Congress has extended the certain provisions of the Mortgage Forgiveness Debt Relief Act through the American Taxpayer Relief Act of 2012 until December 31, 2013. This act benefits qualified homeowners who may have otherwise owed taxes on forgiven debt after going through a short sale. 

HAFA is an initiative offered to homeowners who no longer can stay in their home, and is part of the Home Affordable Modification Program ("HAMP"). HAFA provides options that allow you to gracefully exit your property and avoid costly foreclosure.  Additionally, HAFA offers incentives for relocation if certain requirements are met and the program is successfully completed. HAFA provides the option of a short sale (that is, where your lender will allow you to list and sell your property for less than the total amount due on the first mortgage) or a deed-in-lieu of foreclosure (that is, where you will voluntarily transfer owner- ship of your property to your lender, provided that title is free and clear of mortgages, liens and encumbrances). Upon successful completion of either HAFA foreclosure alternative, you will receive a full release from your first lien mortgage holder.
